JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 15-12-2021 By order dated 25.10.2021, learned Registrar General was directed to seek an explanation from the officer concerned, as to how and under what circumstances bail was granted to the petitioner, albeit the bail application of the petitioner was pending before this Court for consideration.

Perused the explanation at Flag 'B' in which the Incharge Special Judge, Excise, Patna has stated that the petitioner has suppressed this fact that he has also filed regular bail application before the High Court. He had not mentioned this fact in para 2 of his bail petition, therefore, the court below had granted bail to the petitioner.

Considering that the petitioner had suppressed the fact that he had already filed regular bail petition before the High Court, the learned court below is directed to cancel the bail bond

Patna High Court CR. MISC. No.20000 of 2021(5) dt.15-12-2021 2/2 of the petitioner and take legal action against him. The court below is also directed to send a report to this Court about the action taken against the petitioner.

With the aforesaid direction, this application stands disposed of.
