The petitioner is in custody in connection with Kusheshwar Asthan P.S. Case No. 110 of 1997, arising out of S.T. No. 151 of 2007 registered for the offence punishable under Section 147, 148, 149, 307, 353, 216 (A) of the Indian Penal code and 27 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that in fact, the petitioner was granted bail in the instant case but on account of his non-appearance the Court below has cancelled the bail bonds and he has been declared absconder. Patna High Court Cr.Misc. No.11159 of 2019(2) dt.25-02-2019 2/2 accused has been acquitted by the Addl. Sessions Judge-II, Benipur, Darbhanga in S.T. No. 179 of 2004 vide judgment dated 07.04.2018.
Considering the fact that earlier the petitioner was granted bail in the instant case, the Court is inclined to enlarge the petitioner on bail, let the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Addl. Sessions Judge-II, Benipur at Darbhanga in connection with Kusheshwar Asthan P.S. Case No. 110 of 1997, subject to condition that petitioner shall extend full cooperation in disposal of the trial and trial Court is directed to conclude the trial at the earliest preferably within a period of six months.
