Petitioner seeks bail in connection with Sherghati P.S. Case No.574 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016. Learned counsel appearing for the petitioner submits that petitioner has committed no offence and falsely been implicated in this case. Further submits that name of the petitioner has surfaced on confessional statement of co-accused, Dipak Kumar and has no concern with the seized wine. Petitioner is in custody since 23.12.2019.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court CR. MISC. No.8918 of 2020(2) dt.14-02-2020 2/2 bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Gaya in connection with Sherghati P.S. Case No.574 of 2019.
