On trivial issue, it has been alleged that appellant had inflicted rod blow over head of informant, Tuntun Ram as a result of which, he sustained injury. Furthermore, it has also been alleged that petitioner had urinated in his mouth. From the case diary, it is evident that one lacerated wound of size 3.5 cm was found over scalp, nature to be simple caused by blunt substance. Furthermore, from the order impugned dated 24.10.2016, it is evident that appellant was arrested and further, remanded to judicial custody on 14.08.2016. Considering the period of custody in consonance with the nature of allegation, appellant, Vipul Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten

S. Case no.51 of 2016, after setting aside the order dated 24.10.2016 passed by the 3rd Additional Sessions Judge-cumSpecial Judge, S.C./S.T., Muzaffarpur relating to aforesaid case bearing Piyar P.S. Case No.51 of 2016.
Consequent thereupon, appeal is allowed.
