The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47(a) of the Excise Act. 164.5 litres of country made liquor, 20 litres of spirit and other equipments of manufacturing country made liquor were recovered from an orchard alleged to have been kept by the petitioner. The petitioner was found fleeing away from the place of seizure.
It is submitted by learned counsel for the petitioner that the recovery cannot be treated from the possession of the petitioner and a statement has been made in paragraph 3
Patna High Court Cr.Misc. No.3994 of 2016 (2) dt.27-01-2016 2/2 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Vidyapatinagar P.S. Case No. 114 of 2015 pending in the court of learned Additional Chief Judicial Magistrate, Dalsingsarai, District - Samastipur. Accordingly, this application is disposed of.
