The petitioner seeks bail in connection with Sonbarsa P.S. Case No.222 of 2016 registered under Sections 363, 372 and 354 of the Indian Penal Code besides Sections 8/12 of the POCSO Act and Sections 5/6 of the PITA Act.

The accusation is that the petitioner was seen with a girl at Sonbarsa Check-Post by the S.S.B. personnel in suspicion condition. On query, the girl disclosed that she has been enticed away by the petitioner for engaging her in a flesh trade at Nepal. Learned counsel appearing on behalf of the petitioner submits that the petitioner was going to Nepal with the girl for the

No.3890 of 2017 (2) dt.23-02-2017 2/2 treatment of the eye of the girl with the consent of her parents but on mere suspicion, the petitioner and the girl have been apprehended by the S.S.B. personnel. Moreover, in her statement recorded under Section 164 of the Code of Criminal Procedure, the girl has stated about moving with this petitioner for Nepal for the treatment of her eye. The petitioner having no criminal antecedent is in custody since 22.11.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I (Special Court), Sitamarhi, in connection with Sonbarsa P.S.
