The petitioner seeks bail in connection with Sessions Trial No.306 of 2016/34 of 2016, arising out of Hulasganj P.S. Case No.17 of 2016, registered under Sections 452, 302 and 364/34 of the Indian Penal Code, pending in the court of the 1st Additional Sessions Judge, Jehanabad.

The accusation is that five persons, named in the F.I.R., including the petitioner breaking the door entered the house of the informant. When the mother of the informant raised alarm, then this petitioner spread chilly powder at her eyes and caused assault at her temporal region through danda and also pressed her neck

Patna High Court Cr.Misc. No.4863 of 2017 (2) dt.03-03-2017 2/2 through ankle, who died on the spot. It is also alleged that other accused persons also caused assault through fists and slaps to the informant.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case due to land dispute. Further submission is that the petitioner having no criminal antecedent is in custody since 07.02.2016. Having regard to the facts and the circumstances of the case and the nature of allegation, I am not inclined to grant bail to the petitioner. Accordingly, the prayer of the petitioner for grant of bail stands rejected.
