JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-12-2015 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Raniganj P.S. Case No. 211/2014 registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code. Allegedly the petitioner having illicit relationship with the wife of the informant, being in collusion and conspiracy, killed Rajista, aged 1 and 1⁄2 years, daughter of the informant and on the basis of disclosure made by the petitioner and co-accused, the dead body of Rajista was recovered.

Submission is of false implication. There is no direct evidence against the petitioner and only on suspicion, the petitioner has been named, resulting the petitioner is in custody

Patna High Court Cr.Misc. No.35960 of 2015 (4) dt.07-12-2015 2/2 since 05.09.2014 having no criminal antecedent. The learned A.P.P. opposes the prayer of bail by submitting that against the petitioner there is serious allegation and on his disclosure, the dead body has been recovered. In the facts and circumstances stated above, considering that on the basis of disclosure made by the petitioner and co-accused the dead body of the daughter of the informant was recovered and, as such, considering the allegation serious in nature, this Court is not inclined to enlarge the petitioner on bail and, as such, prayer stands rejected.
