JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 147, 148, 149, 341, 323, 337, 504 and 353 of the Indian Penal Code.
It is alleged that during the counting of votes after the assembly elections-2015, the accused persons started pelting stones on the counting booths. The motor cycle of the petitioner was found at the place of stampede.
It is submitted by the learned counsel for the petitioner that during the stampede the petitioner escaped from the scene and there is nothing on record to suggest that petitioner participated in the pelting of stones. Statement has been made in paragraph 3 of
Patna High Court Cr.Misc. No.2563 of 2016 (2) dt.18-01-2016 2/2 the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Aurangabad Town P.S. Case No. 474 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) BKS/- U T
