JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-02-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Buxar (Industrial Area) P.S. Case No. 265 of 2018 for the offenses under Sections 414/34 of the Indian Penal Code. Learned counsel for the petitioner would submit that petitioner is owner of the Garage and from that Garage one motorcycle was seized which is alleged to be stolen one. He submits that the petitioner has no concern with the stolen motorcycle except for the purpose of repair of the motorcycle in his Garage. There is no other activity which connect the petitioner in commission of the crime of theft of motorcycle. The petitioner is in custody since 31.12.2018. The petitioner has no criminal antecedent.

Case No. 265 of 2018.
