JUSTICE BIRENDRA KUMAR ORAL ORDER 08-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.

The petitioner and others are under suspicion to have committed murder of the father of the informant. The case diary would reveal that there is no eye witness to the occurrence and only material against the petitioner is suspicion. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.8253 of 2017 (3) dt.08-04-2017 each to the satisfaction of learned S.D.J.M., Masaurhi, Patna/Successor Court in connection with Masaurhi P.S. Case No.141 of 2016 (G.R.No.490 of 2016), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and subject to the further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
