JUSTICE SANJAY PRIYA ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Section 395 of the Indian Penal Code. It has been submitted that the First Information Report is against unknown. The name of the petitioner has come in the confessional statement of Rajesh Sao who has already been granted bail by a coordinate Bench of this Court vide order dated 23.8.2016 passed in Cr. Misc. 35346 of 2016.

As per allegation in the written report, five unknown miscreants looted away the mobile phone, cash as well as the truck loaded with rice. The petitioner is said to be in custody since 24.9.2016.

In such circumstances, let the petitioner above named,

Patna High Court Cr.Misc. No.3750 of 2017 (2) dt.10-02-2017 2/2 be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, in connection with Sherghati P.S. Case No. 85 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
