For the Petitioner/s :

Mr.Shiv Prasad Gupta, Adv For the Opposite Party/s :

Mr.Narendra Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 30-04-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

According to FIR, for property dispute, murder of Shyamji Singh was committed allegedly by his father and three brothers. For the same dispute, wife of the deceased had sustained burn injury few days ago and her treatment was going on.

Learned counsel for the petitioner submits that there is no eye witness of the occurrence and just to pressurize, only the relations of the wife of the deceased are informant and witnesses of the case.

Patna High Court CR. MISC. No.9201 of 2019(3) dt.30-04-2019 2/2 The Doctor has found multiple injury on the person of the deceased which was cause of death. The dead body was found in the house, where the deceased and other family members were residing. Hence, strong circumstantial evidence is there for which there is no explanation from the petitioner's side. Hence, I am not inclined to enlarge the petitioner on bail for the present in connection with Chandi P.S.Case No.58 of 2018 pending in the court of learned C.J.M., Bhojpur at Ara. Prayer is refused.

Petitioner is in custody since 13.05.2018, hence the learned Trial Court is directed to expedite the trial and conclude the same within nine months.
