The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, petitioner along with other co-accused persons armed with lathi, danda, Farsa, assaulted the nephew of informant. Co-accused Chhotelal Yadav fired upon the son of informant, as a result of which he died during course of treatment.
It is submitted that though there is allegation against petitioner and others of commission of assault upon the nephew of informant, but there is no injury report on the record. Petitioner is not the assailant of deceased. Petitioner claims

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Dhoraiya P.S. Case No. 58 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
