JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-12-2015 Petitioner is permitted to make necessary correction in para-3 of the petition within course of the day. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One country made pistol and six live cartridges are said to have been recovered from conscious possession of the petitioner for which petitioner is in jail custody since 18.07.2015. The contention on behalf of the petitioner is that police engineered the present case in collusion with informant of Chowk P.S. Case No. 211 of 2013 and the aforesaid fact is corroborated from perusal of seizure list as one of the witnesses of seizure list is brother of informant of Chowk P.S. Case No. 211 of 2013.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.56836 of 2015 (2) dt.16-12-2015 2/2 well as submissions of the parties and also taking note of period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Sushant Ranjan, Judicial Magistrate 1st Class, Patna City, Patna in connection with Chowk P.S. Case No. 152 of 2015.
