JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2017 The petitioner is in custody since 29.11.2016 in connection with N.H.Bangra P.S. Case No. 100 of 2016, registered for offences punishable under Section 115, 120B and 414 of the Indian Penal Code and section 25(1-B)A/26/35 of the Arms Act. It has been submitted on behalf of the petitioner that that the petitioner is alleged to have conspired to kill the present Mukhia of the Gram Panchayat and in that connection he along with his son and other accused persons hatched a plan. It has further been submitted that the son of the petitioner has already been granted bail by a coordinate Bench of this Court vide Cr.Misc.No. 1401 of 2017 dated 16.1.2017 and the petitioner remained in custody for about two months.

No.2943 of 2017 (2) dt.31-01-2017 2/2 counsel for the informant that the petitioner is the main kingpin of the case, as such, his case is different from other accused persons. Having heard the learned counsel for both side and considering the submissions, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Samastipur, in connection with N.H.Bangra P.S.Case No. 100 of 2016, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable properties within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move the cancellation of his bail.
