JUSTICE BIRENDRA KUMAR ORAL ORDER 08-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 20 and 22 of the N.D.P.S. Act. From the house of this petitioner, five kilograms of Ganja was allegedly recovered and mother of the petitioner was arrested at the spot. Mother of the petitioner Sobha Devi has already been allowed bail by a coordinate Bench of this Court in Cr.Misc.No.29355 of 2016.

Submission of the petitioner is that the petitioner has got no criminal antecedent.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-

Patna High Court Cr.Misc. No.5636 of 2017 (5) dt.08-05-2017 (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Munger/Successor Court, in connection with Asarganj P.S. Case No.28 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
