====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 16-11-2021 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner seeks bail in connection Bochahan P.S. Case no. 224 of 2020 registered for the offence punishable under section 414 of the Indian Penal Code.

Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the FIR, it would manifest that splendor motorcycle as described in the FIR was seized by the police which was being driven by this petitioner. Learned counsel for the petitioner further submits that from perusal of the seizure list, it would manifest that said motorcycle was seized from new Market, Bochahan as such allegation as alleged in the FIR and what has been recorded in the seizure list does not pollap and petitioner is in custody since 19.08.2020

Patna High Court CR. MISC. No.21312 of 2021(2) dt.16-11-2021 2/2 and charge sheet has been submitted.

Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is in jail custody since 19.08.2020, charge sheet has been submitted and the allegation as alleged in the FIR does not get corroborated from seizure list, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Hemant Kumar, Judicial Magistrate, Ist Class, East Muzaffarpur/concerned court in Bochahan P.S. Case no. 224 of 2020.
