JUSTICE RAVI RANJAN ORAL ORDER 19-01-2016 Learned counsel for the petitioners informs that the petitioner no. 2 Anil Singh has already been taken in custody. Accordingly, learned counsel for the petitioners does not press this application so far petitioner no. 2 is concerned and the same is dismissed as not pressed against the petitioner no. 2. Heard learned counsel for the petitioner no. 1 and the State.

The petitioner no. 1. apprehends his arrest in connection with Sandesh P.S. Case No. 104 of 2015 registered for offences punishable under Sections 147, 148, 149, 341, 323, 379, 504, 506 of the Indian Penal Code and 27 of the Arms Act. It is contended that there is allegation of firing

Patna High Court Cr.Misc. No.57319 of 2015 (2) dt.19-01-2016 2/2 against the petitioner no. 1 Sunil Kumar but there is no injury on any one. There is land dispute between the parties and there is a counter case also. It is submitted that the petitioner is having clean antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, namely Sunil Kumar @ Sunil Kumar Singh be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Sandesh P.S. Case No. 104 of 2015, on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sri Sidhnath Pandey, Judicial Magistrate, 1st Class, Bhojpur at Ara subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
