Versus

State of Bihar & Anr .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Gagan Deo Yadav, Adv. For the Opposite Party/s : Mr. Kanhaiya Kishore(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The basic accusation is of torture for non-fulfillment of the dowry demand.

It is submitted by learned counsel for the petitioner that the petitioner is still ready to keep the informant as wife with full dignity and honour, statement to that effect has been made in para 12 of the petition which reads as follows:- "That petitioner is ready to keep his wife with all respect."

Learned counsel for the informant submits that the informant is ready to accept the offer of the petitioner.

Patna High Court Cr.Misc. No.3729 of 2016 (2) dt.25-01-2016 2/2 It appears that learned court below granted provisional anticipatory bail to the petitioner on certain conditions and consequently the petitioner furnished bail bonds but thereafter due to non-compliance of the condition, the bail bonds of the petitioner were cancelled and finally the prayer for anticipatory bail was rejected.

In view of the fact that the petitioner granted provisional anticipatory bail and consequently he furnished bail bonds, the present anticipatory bail application is not maintainable. Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Sasaram Town P.S. Case No. 999 of 2015 pending in the court of learned CJM, Rohtas at Sasaram. Accordingly, the application is disposed of.
