Petitioner and the informant are full brothers and so far as deceased of the present case is concerned, he was uncle of the informant and the petitioner.

Admittedly, there was land dispute between the parties and the informant claimed to have seen the petitioner from his back side when he is said to have been fleeing from the place of occurrence. Informant expressed his suspicion on the basis of physical feature of the person who was fleeing from the place of occurrence. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Santosh Kumar, Judicial Magistrate, Ist Class, Begusarai/ concerned court in Bhagwanpur P.S.
