The petitioner is accused in connection with Bhagwanpur P.S. Case No. 125 of 2016, registered under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that one mobile set is said to be recovered from the bed of the petitioner bearing SIM No. 9135439276 which would appear to paragraph 33 of he case diary while the SIM No. of looted mobile is 9491291329. The police apprehended the petitioner and got recorded his confessional statement showing the name in present case. Except the confessional statement there is nothing to show

Patna High Court Cr.Misc. No.2446 of 2017 (3) dt.22-02-2017 his involvement in the present case. The petitioner is in custody since 25.08.2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Bhagwanpur P.S.
