2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 175, 409 of the Indian Penal Code.

3. It is alleged that despite repeated reminders, petitioner failed to supply merit list of Niyojit Teacher.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has committed no offence. As a matter of fact, he has been made accused in this case with an ulterior motive. He further submits that entire selection process was conducted prior to his joining on the post of Panchayat Secretary, Babupur. Petitioner took charge on 2.12.2017 and no document or folder of merit list and education certificate is available in the list of charge which was given to the petitioner as such petitioner cannot be held liable for non-

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the facts and circumstances, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate XIII, Bhagalpur in connection with Barahat P. S. Case No. 17 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
