JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Bhadwar P.S. Case No. 23 of 2016, registered under Section 366(A)/34 of the Indian Penal Code.

The accusation is of kidnapping of the daughter of informant by this petitioner.

Learned counsel for the petitioner submits that the statement of the victim has been recorded, under Section 164 Cr.P.C., in which, she denied about her kidnapping as alleged in the F.I.R. and she also denied about developing physical relation by this petitioner with her. It is further submitted that petitioner has no criminal antecedent and is in custody since 16.11.2016.

No.3938 of 2017 (2) dt.23-02-2017 Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Sherghati, Gaya, in connection with Bhadwar P.S. Case No. 23 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
