JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-02-2019 This is an application for grant of anticipatory bail in connection with Sigori P.S. Case No. 83 of 2018, disclosing offences under Sections 30(a), 37(b)(c) of the Bihar Prohibition and Excise Act, 2016.
Allegation is of recovery of 20 liters liquor from the house of petitioner no.1 and recovery of 15 liters liquor from the house of petitioner no.2.
Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and they have no criminal antecedents.
Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners,
Patna High Court CR. MISC. No.10914 of 2019(2) dt.22-02-2019 2/2 above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Sigori P.S. Case No. 83 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. This is further subject to the condition that if in further they will again found in such type of cases, the prosecution will be at liberty to move for cancellation of their bail bonds.
