The petitioner apprehends his arrest in connection with Sonbarsa P.S. Case No. 108 of 2015 for offences punishable under Sections 420, 467, 468 and 474 of the Indian Penal Code. Learned counsel for the petitioner submits that the informant has initially instituted the complaint case which was subsequently registered as an FIR under section 156(3) of the Code of Criminal Procedure.

With reference to the complaint present at Annexure-1 he submits that the foundation of the present case rests on the suspension order passed by the governing body of the college, a copy of which is present at Annexure-4 and which informant terms to be a forged document.

Patna High Court Cr.Misc. No.4945 of 2016 (2) dt.17-03-2016 Learned counsel for the petitioner further with reference to the complaint case instituted by the accused no.4, Ram Shreshtha Raut submits that the informant himself is charged with defalcation and forgery and evidence whereof can be found at Annexure-3 series. He thus submits that the present case by the informant is only a retaliatory action. Having heard learned counsel for the parties and taking note of the circumstances existing, let the petitioner Ram Pravesh Bhagat @ Ram Pravesh Bhakt in the event of his arrest/surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand rupees) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P.S. Case No.108 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
