JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Petitioners are not named in the present case but in course of investigation, they were arrested in Tikapatti P.S. Case No. 69 of 2012, when petitioner No. 1 was caught with stolen motorcycle of the present case and disclosed that he had purchased the said motorcycle from petitioner No. 2 of the present case. The contention on behalf of the petitioners is that petitioners have already been granted privilege of bail in Tikapatti P.S. Case No. 69 of 2012 by coordinate benches of this court and in the present case; they were not put on Test Identification Parade.

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties and also taking note

Patna High Court Cr.Misc. No.57137 of 2015 (2) dt.18-12-2015 of this fact that except the present case as well as Tikapatti P.S. Case No. 69 of 2012, petitioners do not have any criminal antecedent, let the petitioners named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Korha P.S. Case No. 316 of 2012 to the satisfaction of learned Chief Judicial Magistrate, Katihar.
