Petitioner is apprehending arrest in connection with Vishnupad P.S. Case No. 8 of 2020 for the offence under section 30(a), 41 (1) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent.
Learned counsel for the petitioner submits that the allegation against this petitioner is that he was involved in trade of liquor with co-accused Santosh Yadav and allegedly 624.9 liters of foreign liquor was seized from a vacant piece of land which belong to one Jafar Khan. There is total denial of company of Santosh Yadav or Jafar Khan by the petitioner. It is submitted that

Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya, in connection with Vishnupad P.S. Case No. 8 of 2020 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that on release the petitioner shall render his service as volunteer in dedicated Covid-19 hospital for a period of one month. He is required to report to the district Nodal Officer who shall utilize the service of the petitioner appropriately.
