Mr. Damodar Prasad Tiwary, learned counsel for the petitioners submitted that he may be permitted to withdraw the petition as the petitioners desire to surrender before the Court below and prayed that the Court below be directed to consider their prayer without being prejudiced by the present order.

3. In view thereof, as prayed for by learned counsel

Patna High Court CR. MISC. No.20661 of 2021(2) dt.28-09-2021 2/2 for the petitioners, the petition stands disposed of as withdrawn.

4. However, having regard to the prayer made by learned counsel for the petitioners, it is observed that if the petitioners surrender before the Court below within six weeks from today and seek bail, the same shall be considered on its own merits, in accordance with law, without being prejudiced by the present order.
