JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-04-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Nasriganj (Rajpur) P.S. Case No. 37 of 2012, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 506 of the Indian Penal Code and later on Section 302 of the Code was added and Section 17 of the C.L.A. Act. This is the third attempt on behalf of the petitioner for his release on bail. Earlier, the prayers were rejected on 05.03.2020 and 04.08.2021. The petitioner is in custody since 29.11.2018. However, I do not find any new ground for this Court to consider the petitioner's prayer for grant of bail. A report has been received from the court below as regards stage of the trial from which it appears that two of the witnesses have

While dismissing the present application, it is observed that the court below must make endeavour to expedite conclusion of the trial. If there is no substantial progress at the trial, the petitioner shall be at liberty to renew his prayer for bail after six months.
