The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 341, 379, 452, 504 and 506 of the Indian Penal Code.
The prosecution case is that the petitioner and other FIR named accused persons entered into the house of the petitioner for robbing. On protest being made they have misbehaved with the informant and snatched gold chain from the wife of the informant.
It is submitted by learned counsel for the petitioner that co-accused Aman is the tenant of the informant
Patna High Court Cr.Misc. No.4261 of 2016 (2) dt.30-01-2016 2/2 and due to tenancy dispute the accusation has been levelled. The accusation is omnibus and general. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Samastipur (T) P.S. Case No. 196 of 2015 pending in the court of learned Chief Judicial Magistrate, Samastipur.
