JUSTICE ALOK KUMAR PANDEY ORAL ORDER 13-05-2025 At the very outset, learned counsel for the petitioners submits that petitioner no. 1 has been arrested and, hence, the prayer for anticipatory bail with respect to petitioner no. 1 has become infructuous.
2. Accordingly, the prayer for anticipatory bail of petitioner no. 1 stands dismissed being infructuous.
3. Heard learned counsel for the petitioner, namely, Sunaina Devi and learned A.P.P. for the State.
4. The petitioner is apprehending her arrest in connection with Khudaganj P.S. Case No. 89 of 2024 registered for the offences punishable under Sections 80, 238, 3(5) B.N.S.S., 2023.

5. As per prosecution case, petitioner and others are said to have committed the murder of informant's daughter by strangulating her for non fulfillment of demand of dowry.
6. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged in the FIR. Learned counsel further submits that petitioner being mother-in-law of the deceased has falsely been implicated in this case. Learned counsel further submits that petitioner is a widow lady. Learned counsel orally submits that petitioner is residing separately from the family of the deceased and she has no say in the family affairs of the deceased. Learned counsel further submits that there are two children out of the wedlock of the deceased and the co-accused Pravin Kumar Yadav and they were living their life happily but due to serious illness the deceased has died. Petitioner bears no criminal antecedent. In the light of the facts and circumstances of the case, no case is made out against the petitioner.
He further submits that coaccused Sangeeta Devi has already been granted anticipatory bail by the Co-ordinate Bench of this Court vide Cr. Misc. No. 2815 of 2025 and the case of present petitioner stands on similar footing. Hence, she also deserves anticipatory bail.
7. The learned A.P.P. for the State opposes the
Patna High Court CR. MISC. No.9650 of 2025(3) dt.13-05-2025 3/3 prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case, keeping in view clean antecedent of petitioner, co-accused has already been granted anticipatory bail by the Co-ordinate Bench of this Court, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioner, namely, Sunaina Devi in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Hilsa, Nalanda in connection with Khudaganj P.S. Case No. 89 of 2024, subject to the conditions as laid down under Section 482 (2)of BNSS.
9. The application stands allowed.
