2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Saraiya P.S. Case No. 57 of 2023 registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.

3. Earlier the bail application of the petitioner has been rejected vide order dated 14.03.2024 passed in Cr. Misc. No. 17946 of 2024.

4. As per the prosecution case, petitioner is alleged to have killed his wife for demand of dowry.

5. The petitioner is the husband of the deceased and is in custody since 09.10.2023.

6. In the trial, three witnesses have been examined

Patna High Court CR. MISC. No.9285 of 2025(3) dt.27-06-2025 2/2 and independent witnesses have said that the deceased had committed suicide.

7. Considering the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and 11th Additional Sessions Judge, Muzaffarpur/ concerned Court in connection with Saraiya P.S. Case No. 57 of 2023.

9. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed in the trial. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioner.
