JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-01-2018 The petitioners claim that they passed the Intermediate of Science examination held by the erstwhile Bihar Intermediate Education Council in the year 1994 for the session 1992-94. Bihar School Examination Board is the successor Body of the Council. The petitioners have grievance that despite lapse of more than 23 years, their original certificates of having passed the said examination have not been dispatched to the School where the petitioners had studied the said course.
2. It is also the case of the petitioners that the mark-sheets were issued. Copies of the said mark-sheets have been brought on record by way of Annexure-2 series.
3. After 22 years of the petitioners having passed the said examination, it is difficult for this Court to issue such direction in the absence of any plausible explanation for delay in approaching this Court.
4. However, since the petitioners have brought on record photo stat copies of their mark-sheets, this application is disposed of with a direction to the Secretary, Bihar School Examination Board to consider the genuineness of those documents and if the Board is satisfied that such mark-sheets
Patna High Court CWJC No.19083 of 2016(6) dt.23-01-2018 3/3 were issued by the Board, the Board shall issue to the petitioners, duplicate certificate/certificates as the case may be, after fulfilling their requisite formalities. The Secretary of the Board is directed to ensure that an enquiry is made and decision is taken on the grievance of the petitioners within a period of two months from the date of receipt/production of a copy of this order.
