Petitioner apprehends arrest in connection with Balia P.S. Case No. 246 of 2018 registered for the offence punishable under sections 467, 468, 471, 420B/34 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner being a bonafide student passed out Matriculation and thereafter Intermediate also. At the time of appointment she presented the certificate issued by the Bihar School Examination Board and she had no knowledge
Patna High Court CR. MISC. No.24818 of 2019(4) dt.24-04-2019 2/2 that the same is not genuine. As a matter of fact, petitioner has been stopped from discharging her duties as Block Teacher. Moreover, similarly situated accused persons have been granted bail by a Co-ordinate Bench of this Court vide orders dated 06.03.2019 and 29.03.2019 passed in Cr. Misc. Nos. 13766 of 2019 and 19302 of 2019 respectively. Learned counsel has produced the photostat copy of the aforesaid orders. Let the same be kept on record.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Balia P.S. Case No. 246 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
