The petitioner is accused in connection with Motipur P.S. Case No. 338 of 2016, registered under Section 272 and 273 of the Indian Penal Code and Section 30(a), 37(d) of the Bihar Excise Act, 2016.

The accusation is of recovery of one bottle, containing 750 ML and 10 bottles, each containing 180 ML India made foreign liquor from the house of the petitioner. Learned counsel for the petitioner submits that petitioner is in custody since 26.11.2016. Further submission is that petitioner is accused in two other cases, as detailed in para 03 of the petition, but he is on bail in that case. Having regard to the facts and the circumstances of

No.3446 of 2017 (2) dt.13-02-2017 2/2 the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the SDJM, West Muzaffarpur in connection with Motipur P.S. Case No.338 of 2016.
