JUSTICE ASHUTOSH KUMAR) 09-03-2022 Heard Mr. Rajeev Kumar Labh, learned Advocate for the petitioner and Mr. Upendra Pratap Singh for the State.

Mr. Labh, learned Advocate for the petitioner has drawn the attention of this Court to the fact that a Supply (P.D.S.) Appeal No.26/2020 before the appellate authority, mainly, the District Magistrate, Chapra is pending consideration since 09.05.2020 without any good reason.

Patna High Court CWJC No.3108 of 2022(2) dt.09-03-2022 2/2 The licence of the petitioner has been cancelled against which the aforesaid appeal has been filed. We direct the licensing authority, viz, the District Magistrate, Chapra to take up the appeal and decide the same after affording opportunity to the petitioner within a period of sixty days from the date of receipt/production of a copy of this order.

Any further breach in the timeline provided by this Court would be viewed adversely.

The order passed by the appellate authority shall provide reasons for his conclusions.

The petition stands disposed of accordingly.
