2. At the very outset, learned counsel for the respondent-Insurance Company raises a preliminary objection that the instant writ petition has been filed in the year 2015, four years after the I.A. No. 01 of 2011 in Revision Petition No. 710 of 2010 arising out of the order dated 26.05.2009 passed by the National Consumer Disputes Redressal Commission, New Delhi was dismissed as withdrawn after arguments at length.

3. Learned counsel for the petitioner has not disputed this aspect of the matter.
