JUSTICE BIRENDRA KUMAR ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 147/148/149 /341/323 /324 / 307/448/380/504/506 of the Indian Penal Code and Section 27 of the Arms Act.
There is general and omnibus allegation against fifteen accused persons; eight of them were identified by the informant to have committed robbery and assault against the informant.
Submission of the petitioner is that co-accused Rajendra Prasad and others have already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.8846 of 2017 and
Patna High Court Cr.Misc. No.18352 of 2017 (2) dt.19-04-2017 2/2 the petitioner was made accused because on the report of the petitioner a case of electric theft was lodged against the informant and his family members.
Considering the aforesaid facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani/Successor Court, in connection with Laukhi P.S. Case No.194 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
