====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 20-12-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Kusheshwar Asthan P.S. Case No.13 of 2016 for allegedly having committed the offences under Sections 323, 307, 384, 386, 392 and 504/34 of the Indian Penal Code. Learned counsel for the petitioners submits that the main allegation is against Ram Pukar Sah and not against the present petitioners. The present petitioners are the sons of said Ram Pukar Sah, who has since been extended the privilege of regular bail in Cr. Misc. No.44555 of 2016, vide order dated

Patna High Court Cr.Misc. No.50032 of 2016 (3) dt.20-12-2016 6.10.2016. Learned counsel further submits that the entire family has been implicated as there was a partition dispute and the informant sides are co-parceners.

Having considered the aforementioned facts and circumstances and that the petitioners are having no criminal antecedents, let all the three petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of `10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Biraul (Darbhanga), in connection with Kusheshwar Asthan P.S. Case No.13 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
