JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 24.6.2015in a case registered for the offences punishable under Sections 20,21 and 22 of N.D.P.S. Act.
It is alleged that from the motorcycle of the petitioner 1 Kg. ganja was recovered.
It is submitted by the learned counsel for the petitioner that the petitioner was not aware about the ganja being kept in the motorcycle and the weight of the seized contraband appears to have been recorded on speculation as it was stated that it was about one kilogram which is small quantity. The petitioner is accused in four other cases and is on bail in those cases though
Patna High Court Cr.Misc. No.56979 of 2015 (2) dt.17-12-2015 2/2 none of the aforesaid cases are of NDPS Act.
Considering the quantity of recovery and period in custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional District and Sessions Judge, Nalanda at Biharsharif in connection with Bihar P.S. Case No. 291 of 2015.
The learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in similar offence or defaults without any reasonable cause on three consecutive occasions.
