JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-02-2019 The prayer of the petitioner in the present case is regarding correction in the admit card issued for the Intermediate Annual Examination, 2019 wherein instead of the subject Biology, it has been mentioned that the petitioner is required to appear in the subject Mathematics. The contention of the learned counsel for the petitioner is that though through out, the petitioner has been applying for appearing in the Biology subject, the Board has incorrectly issued Admit Card, requiring her to appear in the Mathematics subject.

It is submitted that the Biology paper is scheduled for tomorrow.

Patna High Court CWJC No.1996 of 2019(2) dt.05-02-2019 2/3 The learned counsel for the respondent Bihar School Examination Board submits that ample opportunities were given to the candidates to correct the deficiencies in the admit card or the subject in which they are required to appear and even dummy admit card was issued to the petitioner herein, however, the petitioner has failed to approach the Board for correction. Now it is too late in the day to permit the petitioner to appear in the Biology subject scheduled for tomorrow. It is, however, submitted that the Board has already published a press communique dated 26.01.2019 wherein it has been undertaken that supplementary/compartmental examination shall be held and the result would be published in the month of July, 2019 so that the session of such candidates are not lost.

Hence, it is submitted that the Board would accommodate the petitioner in the supplementary examination for the subject Biology. The learned counsel for the petitioner submits at this juncture that the petitioner has no choice and she would opt not to appear in the Mathematics subject in the Annual Examination, 2019 and would appear in Biology subject in the Special Examination to be conducted by the Board in the month of May, 2019 so that final consolidated result is published latest by the month of July, 2019.

Patna High Court CWJC No.1996 of 2019(2) dt.05-02-2019 3/3 It is needless to state the present order is being passed by the consent of the parties and accordingly it is directed that while the petitioner would be permitted to appear in the other subjects apart from Mathematics subject in the Intermediate Annual Examination, 2019, she would be simultaneously allowed to appear in the Biology subject in the Special Examination to be held in the month of May, 2019 and a consolidated result of all the subjects would be published in the month of July, 2019 by the Board.

The writ petition stands disposed off on the aforesaid terms.
