JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-02-2019 This is an application for grant of anticipatory bail in connection with Warisaliganj P.S. Case No. 335 of 2018, disclosing offences under Sections 341, 323, 504, 384, 427 of the Indian Penal Code.
Allegation against the petitioners and other accused persons is of demanding money from the informant on the point of pistol and also abused him.
Submission of learned counsel for the petitioners is that though they are named in the F.I.R., but no specific allegation has been attributed against them. Further, they have falsely been implicated in this case and having no criminal antecedents.
Heard learned A.P.P. also, who opposed the prayer for
Patna High Court Cr.Misc. No.10899 of 2019(2) dt.22-02-2019 2/2 anticipatory bail of the petitioners.
Having heard both sides, in view of the facts and circumstances of the case, this application is disposed of with a direction to the petitioners to surrender before the court below within a period of six weeks from the date of receipt of the order and pray for regular bail, which will be considered on its own merit without being prejudice by order of this Court, if possible, to be disposed of on the same day.
