ANJANA MISHRA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 364/34 of the Indian Penal Code.

Diary in this case was called for earlier which has since been received.

Learned counsel for the petitioners submits that save and except the allegation that the petitioners had called the victim to come to their place to celebrate Eid, there is no further material to show that the petitioners were in anyway responsible for the disappearance of the victim, the husband of the informant.

Patna High Court Cr.Misc. No.4422 of 2016 (4) dt.26-04-2016 Learned counsel appearing on behalf of the State after perusal of the case diary submitted that apart from the allegation made in the First Information Report, there is no further material in the case diary to implicate the present petitioners. Considering the aforementioned facts and circumstances and the nature of allegations made and also that the petitioners have no criminal antecedent, let the petitioners abovenamed, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 484/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
