JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 14-12-2015 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek bail in connection with Sathi P.S. Case No. 159/2015 registered under Section 147,148, 149, 302, 120(B) of the Indian Penal Code and 27 of the Arms Act. It is contended the petitioners were simply members of unlawful assembly and the specific allegation of causing firearm injury is against co-accused Bhutkun Singh, Vijay Singh, Suresh Singh and Awadhesh Sah.

No.55920 of 2015 (2) dt.14-12-2015 2 / 2 On the other hand, learned counsel for the informant has contended that the petitioners have actively participated in eliminating the husband and son of the informant. The bail application of the co-accused Binda Singh whose case is identically situated to that of the petitioners has already been rejected by a Bench of this Court vide order dated 14.12.2015 passed in Cr. Misc. No. 55594 of 2015.

Regard being had to the gravity of the offence in which two persons have been killed and the fact that the coaccused has been denied bail by a co-ordinate Bench of this Court , I am not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected (Ashwani Kumar Singh, J.) Sanjeet/- U T
