The petitioner apprehends his arrest in connection with Kishanganj Mahila P.S. Case No. 20 of 2016 registered under Sections 376, 504, 506/34 of the I.P.C. pending in the Court of S.D.J.M., Kishanganj.
Submission is that the allegation levelled against the petitioner is false. He has been made accused in this case due to ulterior motive by the informant. It is also submitted that petitioner has no criminal antecedent.
Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner with submission that there is direct allegation of committing rape against the
Patna High Court Cr.Misc. No.19451 of 2017 (3) dt.06-07-2017 2/2 petitioner. The victim in her statement under section 164 Cr. P.C. has fully supported the alleged occurrence and the witnesses have also supported the prosecution version in several paragraphs of the case diary. Hence, he deserves no bail.
Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
