The petitioner seeks bail in connection with Motihari Town P.S. Case No.682 of 2015 registered under Sections 457 and 380 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. itself that the name of the petitioner has been disclosed by the co-accused, Sally Raj, who is said to be the driver of the informant, in this case. It is also submitted that no incriminating articles have been recovered from the possession of the petitioner and the petitioner having no criminal antecedent is in custody since 07.10.2015.

No.56289 of 2015 (2) dt.16-12-2015 2/2 Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, at Motihari, East Champaran, in connection with Motihari Town P.S. Case No.682 of 2015. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
