JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have caught the informant from her backside. The informant appears to be minor but submission on behalf of the petitioner is that no case under Section 354 B of the Indian Penal Code is made out and similarly, Section 8 of POCSO Act, 2012 is also not applicable in the present case. It is further contended by him that petitioner is in jail custody since 13.11.2015 and as a matter of fact, there was some dispute between petitioner and father of the informant on the point of money transaction.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with
