JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-07-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Naugachia P.S. Case no. 228 of 2019, registered under Sections 323, 341, 307, 386 and 387/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that it appears from the F.I.R. that on the basis of fardbeyan of Pradip Kumar Bhagat @ Pappu Bhagat, Naugachia P.S. Case no. 228 of 2019 was instituted on 10.07.2019, under Sections 323, 341, 307, 386 and 387/34 of the Indian Penal Code and Section 27 of the Arms Act against four motorcycle riders. Further submission is that in course of investigation, Dilip Kumar Chaudhary and Gautam Kumar @ Chiranjiv Karmkar were
Patna High Court CR. MISC. No.12816 of 2020(2) dt.02-07-2020 2/2 apprehended, who confessed their guilt and they also disclosed the name of petitioner saying that at the time of occurrence, the petitioner was doing work of liner except that nothing has been collected by the I.O during the course of investigation. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Naugachia, Bhagalpur in connection with Naugachia P.S. Case No. 228 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
