2. The petitioner seeks regular bail in connection with Janki Nagar P.S. Case No. 354 of 2024, registered for the offence under Sections 8(c)/21(b) of the N.D.P.S. Act.

3. As per prosecution, total 1.26 grams of smack and one mobile were recovered from the spot. The petitioner is in custody since 03.10.2024.

4. This application is disposed of with a direction to the learned 3rd Addl. Sessions Judge, Purnia to explain to the petitioner /accused the fact that the recovery is of small quantity and the maximum punishment for the offence is one year and if he pleads guilty, he may be let off after completing a particular period in custody.

5. If the petitioner pleads guilty, appropriate orders shall be passed by the Court below. In case, the petitioner does not plead guilty, he shall be released on bail by the learned 3rd Addl. Sessions Judge, Purnia.
